Henry Davis York senior insolvency partner John Martin delivered a paper at the United Nations' 50th Anniversary UNCITRAL (the UN's International Trade Law Commission) Congress in Vienna.
The theme of the Congress is Modernising International Trade Law to Support Innovation and Sustainable Development. In addition to UN member nations, Congress is attended by leaders in the field of international trade law, including practitioners, academics, international officials and other experts. Participants at the Congress are examining ways in which UNCITRAL can contribute to managing new development issues and fostering innovation.
The paper delivered was on the topic of cross border insolvency and addresses the problem of inconsistent insolvency judgments internationally, and invited UNCITRAL to accept a reference to explore international consensus to resolve the problem in the ways suggested in the paper. The paper arose out of a panel discussion, which John chaired, at last year's Tokyo conference of the International Insolvency Institute. John serves as Vice President of the Institute. The paper, which was jointly authored with Professor Ros Mason, was selected for presentation following a competitive process.
