CAMAC Discussion Paper - Managed Investment Schemes
Members of unlisted managed investment schemes (MIS) should be granted more appropriate voting powers according to a detailed submission Henry Davis York (HDY) has made to the Corporations and Markets Advisory Committee’s (CAMAC) wide-ranging review into the sector.
The submission also argues that voluntary administration is not a suitable option for insolvent MIS, and advocates for an alternative solution used in the insurance and banking industries called judicial management as being more efficient.
HDY’s submission focuses on a handful of core reform areas raised by CAMAC’s discussion paper that are important to its clients and covered by the legal firm’s financial services practice – which advises responsible entities, superannuation trustees and foreign groups expanding into Australia – and insolvency practice.

ED Corporations Amendment (FoFA) Bill 2011
Henry Davis York has made a submission to Treasury on the Exposure Draft - Corporations Amendment (Future of Financial Advice) Bill 2011.
Key issues covered in our submission include the proposal to give ASIC the power to refuse, suspend or cancel and Australian Financial Services Licence and to make a banning order should only apply where ASIC has formed the view that the contravention is significant and is likely to cause a loss to clients, and
the definition of ongoing fee arrangements in the new section 962A should be limited to personal advice situtations.

ED of Tax Laws Amendment (2011 Measures No.2) Bill 2011: Use of TFNs for superannuation
HDY's submission cites the lack of a unique member identifier which could be used to verify a person's identity as a superannuation fund member, link their superannuation accounts, with contributions made for them, or identify multiple accounts held by the same person.

Tax Arrangements for Collective Taxation Vehicles
Henry Davis York has made a submission to Treasury on the Terms of Reference for a review by the Board of Taxation into the taxation arrangements that apply to collective investment vehicles(CIVs). CIV's which currently hold around $1.3 trillion in investments, are widely held investment vehicles with typically long-term portfolio investors that undertake primarily passive investment activities.
