Tom has over 12 years' experience in commercial dispute resolution. He was previously an associate to a judge of the Federal Court of Australia. In addition to his general commercial disputes practice, Tom specialises in financial services, funds management and trustee disputes.
Tom has experience advising and acting for clients in a broad range of commercial disputes, including negligence and defamation, contractual disputes, equity, trusts and property (including retail and commercial lease disputes) and disputes under the Competition and Consumer Act 2010 (formerly the Trade Practices Act 1974).
Tom advises and acts for a number of financial institutions and companies in the financial services industry, including fund managers, boutique fund managers, banks and investment banks. His clients also include public companies and large private companies in the property, hospitality and leisure and information technology sectors.
His practice also includes acting for individuals in financial services claims and in other commercial and regulatory disputes, along with all forms of alternative dispute resolution.
Tom has conducted proceedings in the Local, District and Supreme Courts of NSW, the High Court of Australia, the Federal Court of Australia, the Supreme Courts of Queensland, ACT and Victoria and in a number of statutory tribunals and boards, including the Companies Auditors and Liquidators Disciplinary Board established under the Corporations Act.
His significant matters include acting for:
- a trustee and manager in relation to multimillion dollar claims for breach of trust and negligence against the former trustee and former manager of two property funds
- a national hotel chain defending a multimillion dollar claim for breach of contract and restitution
- a provider of online investor relations services in a claim for breach of confidentiality, and
- a group of companies supplying therapeutic goods in a multimillion dollar claim against the Commonwealth of Australia for damages for misfeasance in public office and negligence.
