Claudine advises major financial institutions and insolvency practitioners covering matters dealing with fraud, security enforcement, debt recovery, banking and insolvency litigation.

Claudine is currently acting for a bank and its appointed receivers in relation to the receivership of a group of companies involved in property development. Claudine is also currently representing voluntary administrators appointed to a group of companies which are also involved in property development. The administration involves complex trust structures and a large property portfolio.

Other matters in which Claudine has acted include successfully representing one of the top four banks in high-profile fraud proceedings in relation to an advance of A$7 million under a receivables finance facility. Claudine played a significant role throughout the proceedings, including assisting the bank to obtain freezing orders from the Court prior to the final hearing, and obtaining a search order relating to one of the defendants. The search order also involved the engagement of a forensic computer expert.

Claudine also recently acted for another of the top four banks in a separate successful fraud proceeding, during which she worked closely with the New South Wales Crime Commission due to the serious nature of the matter.

Additionally, Claudine is acting for one of the top four banks in a multi-party mortgagee dispute involving the forgery of a number of mortgage and loan documents. The matter traverses a number of legal principles including indefeasibility of title, breach of mandate and proportionate and concurrent liability and is currently on appeal to the New South Wales Court of Appeal.

Claudine was appointed to the Partnership in July 2011. She has worked flexibly since returning to work from a period of maternity leave in 2010. At the time of her promotion to the Partnership Claudine was working three days per week and now works four days per week. She is an excellent example of how flexible working can be executed very successfully through effective ongoing communication and this is testament to both Claudine and her practice group.
