Overview

Henry Davis York's dedicated projects and infrastructure team has extensive experience in assisting both government and the private sector across the full range of project delivery models. We have advised clients on many of Australia's largest and most complex infrastructure projects such as the Pacific Highway upgrade, the Gold Coast Light Rail project RailCorp's automatic train protection system and DEXUS Group's NSW flagship industrial development.

Australian and State Governments are committing significant funding to infrastructure projects. Our government clients seek trusted advisers, with a deep understanding of their needs in procuring infrastructure. Both our government and private sector clients want to ensure that their projects are delivered on time and within budget and are delivered without any adverse legal or commercial consequences.

Credentials

Rail Corporation NSW (RailCorp)

We acted for RailCorpin relation to the project for the maintenance of its electric fleet of trains. We have assisted RailCorp to develop the procurement strategy for this complex project and prepared all documentation for the EOI and RFT stages of the project, including the lease of the project site and documents retaining necessary access rights to RailCorp.

We advised RailCorp on its rollout across its rail network and fleet of rollingstock an Automatic Train Protection (ATP) System based on a European Train Control System. Our work involved preparing the tender documentation and project deeds for the supply, installation and ongoing technical support for the onboard and trackside systems.

Sydney Ports Corporation

We advised Sydney Ports Corporation on its Request for Proposals (RFP), for the procurement of a new terminal operator for the third stevedore terminal at Port Botany.

We acted for Sydney Ports Corporation on its RFP for the proposed development of an Intermodal Logistics Centre at its 59 hectare site at Enfield for an intermodal terminal with rail and road access, two empty container storage areas and a number of warehouse areas.

DEXUS Group

We advised the DEXUS Group on the ongoing development of its NSW flagship industrial estate at Greystanes.

Sydney CBD Metro Project

We advised Ansaldo in its bid to be shortlisted as the operator under the IMO Contract with the Sydney Metro Authority for the Sydney CBD Metro Project. We prepared the joint venture agreements with Ansaldo's bid partners, John Holland and the Royal Bank of Scotland, and undertook considerable and detailed work in the negotiation of construction, operation, maintenance and interface arrangements in respect of this complex high profile project.

Gold Coast Rapid Transit Project

We advised Hong Kong-based MTR Corporation on its bid to be operator of the Gold Coast Light Rail Project including participation across all aspects of the transaction, from project deed level through to the operation and maintenance.

QPAM Pty Limited

We advised the developer of this project to prepare the documentation for the Auckland City Arena, New Zealand's first BOOT project. The developer entered into a joint venture with an American-based organisation and contracted with Auckland City Council for the development of the project in return for a 40 year concession.

RTA

We advised on the Pacific Highway upgrade in preparing multi-staged project documentation which included an expression of interest, tender packages, the design construct and maintain project deed and ancillary documentation for this significant road project and ongoing contract administration and dispute resolution.

The Precision Group Pty Limited

We were retained by the Precision Group in relation to their acquisition of the retail stratum of the Chatswood Interchange Development to ensure that the design and construction of a significant component of the works met with our client's performance requirements as contractually agreed. The contractual obligations of our client were significantly complicated by the time pressures associated with completing this project on time. The matter required a number of urgent Supreme Court proceedings and we met every time frame imposed by the client and by the Court in those proceedings.
