John Martin

John's expertise is in both financial sector dispute resolution and corporate insolvency and restructuring, with a particular specialty in cross-border insolvencies.

Domestically, John has an extensive practice advising in connection with large and complex insolvencies. His clients include several of Australia's major trading banks, as well as insolvency practitioners appointed to insolvent entities.

Internationally, John has advised in connection with insolvencies in England, Fiji, Bermuda, Cambodia, Brunei, and Norfolk Island. John's cross-border experience has included assisting financial sector clients address complex international fraud, including a A$160 million financial fraud involving a major international bank.

In the insurance insolvency sphere, John is the principal legal adviser to the Australian liquidator of New Cap Reinsurance Corporation Limited (in liquidation) and the deed administrator of AFG Insurances Limited (subject to deed of company arrangement). He also acted for one of the appellants in the successful HIH appeal to the House of Lords, in which the court accepted our client’s position that "modified universalism" should be a guiding principle in cross-border insolvencies.

John is a member of the Law Council of Australia's Insolvency and Reconstruction Committee, and the Insolvency Practitioners Association of Australia. He is listed as a "Leading Individual" in Restructuring and Insolvency in the following independent industry recognised publications:

He has spoken on insolvency issues at numerous domestic conferences as well  internationally in the US (2002, 2006), UK (2001), South Africa (2007), Canada (2009). He has had opinion articles published in the Australian Financial Review, and has been published in the Insolvency Law Journal.
